Terms of Service

These terms govern your use of claimthemarket.com. By creating an account, publishing a listing or placing a bid, you agree to them on behalf of yourself and the business you represent.
1. What the service is
Claim The Market sells advertising placements. A market is one city plus one business category, and each market has exactly one #1 Featured Business slot held by the highest active bid. Placements are advertising, not editorial rankings, awards, reviews or certifications.
2. Accounts
You must be 18 or older and authorised to act for the business you list. Keep your credentials secure; you are responsible for activity under your account. We may suspend accounts used for fraud, impersonation or abuse.
3. Listing content and your licence to us
You warrant that your business name, description, website, logo and images are accurate and that you own or license them. You grant us a non-exclusive, worldwide, royalty-free licence to host, display, resize and distribute that content on the site, in badges, in previews and in machine-readable feeds while your listing is live.
4. Bidding and payment
- Unclaimed markets open at the displayed starting bid. Claimed markets require the current highest bid plus the market's minimum increment.
- Every bid is processed through our payment processor and is authorised at the moment you place it.
- If you already hold #1, raising your bid charges only the difference.
- Bids whose payment fails or is reversed are voided and the prior highest bid is restored.
5. Duration of a placement
There is no auction end time. You hold the #1 position continuously until another business bids higher, at which point your listing leaves the featured slot. Ownership history for every market is public.
6. Refunds
Placements are advertising already delivered, so amounts charged are not refunded when you are later outbid. We refund payments for placements that never went live or that we remove for reasons outside your control. Chargeback abuse may result in account termination.
7. Prohibited use
- Impersonating another business, or listing a domain you do not control.
- Duplicate listings for the same business or domain.
- Illegal, deceptive, adult, hateful or dangerous offerings.
- Scraping, rate-abuse, reverse engineering, or interfering with bidding or payments.
8. Moderation and disputes
Anyone may report a listing. We may suspend or remove listings for fraud, misrepresentation, prohibited industries or impersonation, and suspended listings lose their positions. We aim to review reports promptly and will tell you the reason for a removal affecting your listing.
9. Availability and changes
The service is provided on an as-is and as-available basis. We may change features, pricing tiers, increments or market inventory. Material changes affecting live placements are communicated by email.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, lost profits, or lost business opportunity. Our total liability for any claim is limited to the amounts you paid us in the 12 months before the claim. We make no guarantee of leads, calls, revenue or search rankings.
11. Indemnity
You will indemnify us against claims arising from your listing content, your business conduct, or your breach of these terms.
12. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Disputes are resolved in the state or federal courts located in Miami-Dade County, Florida.
